By purchasing products on this website, you agree to our refund and return policy. Because our products are cosmetic in nature, and because customer safety is our top priority, we do not accept refunds for products that have been opened from their original packaging. 

Color Policy: Unfortunately, we are not able to accept returns, exchanges or refund requests for opened products on the basis of an incorrect/non-matching shades. The pictures provided on our website are for guidance only, and can not always take into account lighting, screen resolution, or how a color looks against a particular skin tone. We are not responsible for replacing, exchanging, returning or refunding products that are not a correct color match.

If your product arrives damaged or defective, please email us at info@tuesdayinlove.com to set up an exchange. In order to receive an exchange, you must send us a photo (or video if required) of the product and the associated damage.

For general returns of unopened products, an email notification must be sent to us within 24 hours upon receipt/delivery of the order - note that refund/exchange requests made after this time period will not be accepted. To return an item, you must ship the product back to us in its original, unopened packaging without any damage or tampering. The customer will be responsible for paying for return shipping back to us. We strongly recommend using a tracked service, as we are not responsible for return packages that get lost, stolen or damaged. 

All returns of unopened products will be subject to a 25% restocking fee, deducted from the total refund owing. 

FOR RETURNS OF ITEMS PURCHASED BY OTHER RETAILERS: If you have purchased an item from a retailer other than the Tuesday in Love home website, you must contact the specific retailer where your order was made for returns/exchanges/refunds.

PAO Policy: we will not accept returns or exchanges if your order was delivered more than 30 days prior to your return/exchange request date.

We offer free shipping on all orders over $100 CAD to the following countries: Canada, United States, United Kingdom, France, and Netherlands.

Orders shipped within Canada usually arrive within 5-7 business days. Orders shipped to the US usually arrive within 10-12 business days. International orders can take 15-20 business days to arrive.

Due to customs regulations and international import laws, we DO NOT SHIP to the following countries: Iran, Iraq, Behrain, Oman, Saudi Arabia, United Arab Emirates, Jordan, Turkey, Germany, Russia and some Russian Federation countries.

WE ARE NOT RESPONSIBLE FOR THE FOLLOWING SHIPPING CONCERNS:

• Mistakes made by the customer in their shipping information. If you provide us with the wrong address or forget to include any necessary address information, including but not limited to an apartment/condo number, the customer is responsible for paying for a new shipping label to re-ship the product.
• Stolen packages. It is the customer's responsibility to provide a shipping address that can safely receive orders.
• Declined customs/duties charges. Tuesday in Love WILL NOT cover the cost of customs, duties or taxes for any orders.
• Packages delivered in error to a neighbor. It is the customer's responsibility to communicate with their neighbors and retrieve any packages delivered there accidently.

IF YOUR ORDER IS DECLINED/RETURNED TO SENDER FOR ANY REASON:

• The customer will be responsible for paying for a new shipping label to have the order shipped again.
• If you decide to abandon your order for any reason and it is returned to us, your order will be refunded, however a 25% restocking fee will be applied, as well as a $15 CAD shipping charge for the original label if your original order received free shipping.

If you are ordering within Canada or the US, it is very unlikely that your order will incur duties and taxes, especially if it's under $200. However, we cannot guarantee that your order will not incur additional taxes, duties, or other shipping/customs fees. We will not reimburse customers who are subject to these fees, and we will not provide a refund for this reason. International customers must determine any expected fees prior to ordering.

If you decline your package due to duties/customs and it is returned to Tuesday in Love, you will need to pay for a new shipping label again if you wish to receive your order. 

Packaged orders will not contain invoices, but your invoice will be emailed to you once your purchase is made online through the Tuesday in Love website. Customs offices do make occasional random checks on parcels and may hold your order for up to 2 weeks before releasing it to your local postal service. Tuesday in Love is not responsible for any custom fees or duties applied to orders by local customs officials and will not offer refunds for custom duties.

If you wish to abandon your order, it will be subject to a 25% restocking fee, as well as a $15 CAD shipping fee charge if your original order was shipped with a free shipping promotion.

- To respond to your inquiries to Tuesday In Love and fulfill your requests, to send newsletters or to update you about Tuesday In Love news and events, or to provide your personal information to Tuesday In Love independent sales and leadership representatives when you provide it to us for such purpose;
- To send you information about specials, new products and services, and other items that may be of interest to you;
- To contact you and/or answer questions concerning your account (for example, order delivery, invoicing or evaluate credit standing);
- To manage and develop Tuesday In Love's business strategies, forecasting and trending, marketing plans and operations;
- To initiate, maintain and assist you in developing your Tuesday In Love business. For example, by processing the Tuesday In Love appointment contract, creating sales and leadership representative reports;
- While filling out a form or survey online (for example, for internal marketing and statistical purposes), or by entering a contest, sweepstakes or other promotion;

In the event Tuesday In Love were to decide to share such information, we will give you the opportunity to refuse the transfer of personal information.
Tuesday In Love may however transfer your personal information to the following parties:
- Independent Leadership Representatives: Tuesday In Love may disclose Tuesday In Love independent sales representative or downline information. If you are an independent sales representative, we may disclose certain personal information to other Tuesday In Love independent sales representative (for example, if you are a "downline" Tuesday In Love independent sales representative, we may make your personal information and other information about you available to your upline leadership representative and all generations in your unit, in order to monitor sales activity and provide business development, including training, recognition.)
- Service providers, collection agencies and/or any other person or company acting as an agent of Tuesday In Love, in order for them to provide services required by Tuesday In Love and/or manage Tuesday In Love's business (for example, an alternate support person who supports a District Sales Manager or a service provider who may host our sites and deliver email and/or mobile messages).
- Employees of Tuesday In Love (for example, head office, district sales managers or division sales managers) who have a need to access customer and/or independent sales and leadership representative's personal information in carrying out their responsibilities.
- Third parties for direct marketing purposes. We may disclose your personal information to third parties for their direct marketing purposes only when you affirmatively consent to such disclosure. For example, from time to time, we may give you the opportunity to opt in to participate in special third-party offers that require Tuesday In Love to share certain personal information with such third parties. We will disclose this anticipated sharing of personal information at the time we make such opportunities available to you. If you opt in to participate in such an offer, we may disclose your personal information to such parties for their direct marketing purposes. - This Policy does not apply to the collection, use or disclosure of information by Tuesday In Love independent sales representatives, who are independent third-party contractors of Tuesday In Love and are not otherwise affiliated with Tuesday In Love. For example, information you may provide to your independent sales representative through her InterTuesday In Love.ca site or a personal email.
- The Tuesday In Love website may contain links to websites operated by third parties, or may embed services operated by third parties ("Third Party Sites/Services") and these third parties may have privacy practices that are different from ours. If you provide information through any Third Party Sites/Services, such information will be collected by, and may be used and disclosed by such third parties, in accordance with the privacy practices and policies of such third parties. Tuesday In Love website users should consult such third parties' privacy policies when using Third Party Sites/Services, as Tuesday In Love has no control over the use or disclosure of information by third parties. Tuesday In Love is not responsible nor liable, under any circumstances, for these third parties' practices, actions or policies regarding their sites, and cannot be held accountable for the contents and confidentiality practices of these sites.
- Non personally identifiable information (Non-PII), which is aggregated information, demographic information, IP addresses and any other information that does not reveal your specific identity. By using our website, you (the visitor) agree to allow third parties to process your IP address, in order to determine your location for the purpose of currency conversion. • A “TUESDAY IN LOVE Independent Sales Representative”is an individual (a) who has agreed, pursuant to the terms of a Tuesday in Love Independent Sales Representative Contract, to be a TUESDAY IN LOVE independent sales representative and (b) who remains an active TUESDAY IN LOVE independent sales representative in good standing.

If you are a TUESDAY IN LOVE Independent Sales Representative, you acknowledge and agree that your use of the TUESDAY IN LOVE WEBSITE is subject not only to this Agreement, but also to the terms and conditions contained in your TUESDAY IN LOVE Independent Sales Representative Contract and any applicable Tuesday in Love policies, codes of conduct or other related guidelines.

1. Content Posted by TUESDAY IN LOVE Independent Sales Representatives

TUESDAY IN LOVE Independent Sales Representatives are independent third party contractors of TUESDAY IN LOVE and are not otherwise affiliated with TUESDAY IN LOVE or any of TUESDAY IN LOVE’s parent companies, subsidiaries or affiliates (collectively “Affiliates”). TUESDAY IN LOVE is not responsible or liable for the statements, acts or omissions of TUESDAY IN LOVE Independent Sales Representatives, whether through or in connection with the TUESDAY IN LOVE WEBSITE or otherwise. Without limiting the foregoing, although TUESDAY IN LOVE may provide TUESDAY IN LOVE Independent Sales Representatives with certain resources and tools (including without limitation assistance with the creation of personalized online sites that contain TUESDAY IN LOVE branding and content and that may share URLs in whole or in part with the TUESDAY IN LOVE WEBSITE), you acknowledge and agree that neither TUESDAY IN LOVE nor any Affiliate has control over, or is responsible or liable for, any text, images, or other information or materials posted by TUESDAY IN LOVE Independent Sales Representatives to the TUESDAY IN LOVE WEBSITE or such personalized online sites. For purposes of clarity, you retain ownership of any Submissions that you post, subject to the terms and conditions of this Agreement (including the license grant in Section 5(b) below). For the sake of clarity, TUESDAY IN LOVE, the Affiliates or our or their respective licensors or suppliers, as applicable, shall retain ownership of the Tuesday in Love Content.
3. License Grant.For each Submission that you post, you hereby grant to us and the Affiliates a world-wide, royalty free, fully paid-up, non-exclusive, perpetual, irrevocable, transferable, and fully sublicensable (through multiple tiers) license, without additional consideration to you or any third party, to: (i) reproduce, distribute, transmit, perform and display (publicly or otherwise), make available to the public, adapt, modify, edit, translate, make, sell, offer to sell, import, and otherwise use and exploit (and have others exercise such rights on behalf of us or the Affiliates, through multiple tiers) such Submission, any ideas accompanying, related to, or embodied in such Submission, and any materials embodying, incorporating, or derived from such Submission, in any format or media now known or hereafter developed; (ii) create derivative works from such Submission (including without limitation by incorporating such Submission into any other work, or into our, the Affiliates’ or our or their respective designees’ products or services); (iii) exercise all trademark, publicity and other proprietary rights with regard to such Submission; (iv) use your name, photograph, portrait, picture, voice, likeness and biographical information as news or information and for advertising or promotional purposes, whether or not in connection with your Submission; and (v) use your Submission (including the contents thereof and any derivative works thereof) for any advertising or promotional purposes. IF YOU DO NOT WISH TO GRANT THE RIGHTS GRANTED IN THIS SECTION 5, PLEASE DO NOT POST ANY SUBMISSIONS ON THE TUESDAY IN LOVE WEBSITE.
4. Disclaimers.It is possible that TUESDAY IN LOVE WEBSITE visitors will post information or materials on the TUESDAY IN LOVE WEBSITE that are wrong or misleading or that otherwise violate this Agreement. We, the Affiliates and our and their respective directors, officers, employees, agents, representatives, licensors and providers do not endorse and are not responsible for any information or materials made available through the TUESDAY IN LOVE WEBSITE or your use of or reliance on such information or materials. All Submissions will be deemed to be non-confidential and may be (i) disclosed to the general public and (ii) used by us without (A) any confidentiality or other non-disclosure obligations or (B) attribution to you or any third party. We reserve the right, at any time and in our sole discretion, to set limits on the number and size of Submissions that may be posted on the TUESDAY IN LOVE WEBSITE or the amount of storage space available for Submissions.
5. Acknowledgement.You hereby acknowledge and agree that (i) you have received good and valuable consideration in exchange for the rights granted by you hereunder in and to any Submission that you post, which consideration includes, without limitation, the ability to participate in activities on the TUESDAY IN LOVE WEBSITE and the possibility that publicity or favorable exposure may arise from our or the Affiliates’ use of such Submission or any derivative works incorporating or embodying such Submission; and (ii) you are not entitled to any further compensation for any use or other exploitation of such Submission by us or the Affiliates or any other party in connection with the rights in such Submission that have been granted hereunder and/or that are available under applicable law.

Representations and Warranties.You hereby represent and warrant that: (i) you have the legal right and authority to enter into this Agreement; (ii) you solely own, or otherwise have the full right and permission to exploit, all of the rights in, to, and under any Submission that you post and to grant the rights and licenses set forth herein, and with respect to any third party materials that appear in or are otherwise incorporated or embodied in any Submission that you post, you have obtained express, written clearances from all owners of and rights holders in such third party materials as necessary to grant the rights and licenses set forth herein; (iii) any Submissions that you post, and the use thereof by us, the Affiliates, our and their respective designees, and other users of the TUESDAY IN LOVE WEBSITE do not and shall not infringe or violate any patent, copyright, trademark, trade secret, or other intellectual property rights or other rights of any third party; (iv) any Submission that you post is not confidential and does not contain any confidential information; (v) in creating, preparing and posting any Submission, you (A) have complied and will comply in all respects with all applicable laws, rules (including without limitation our rules of conduct set forth in Section 4 above), and regulations and (B) have not violated and will not violate any understanding by which you are explicitly or implicitly bound (including without limitation any agreement with any third party) and (vi) you have obtained the written consent, release, and/or permission of every identifiable individual who appears in any Submission that you post, to use such individual’s name and likeness for purposes of using and otherwise exploiting such Submission(s) in the manner contemplated by this Agreement, or, if any such identifiable individual is under the age of majority, you have obtained such written consent, release and/or permission from such individual’s parent(s) or guardian(s) and from any other entity from whom such consent, release or permission is required (and, in each case, you agree to provide to us a copy of any such consents, releases and/or permissions upon our request). If you do post a Submission that contains the likeness of an identifiable individual, we strongly encourage you not to include any identifying information within such Submission, such as the individual’s name or address.
7. Waiver; Further Assurances.To the extent permitted under applicable law, you agree to forever release, discharge and waive all claims against us, the Affiliates and our and their respective directors, officers, employees, agents, representatives, licensors and providers from, and covenant not to initiate, file, maintain, or proceed upon any claims, demands, actions, losses, costs, damages, liabilities, judgments, settlements or expenses (including without limitation reasonable attorneys’ fees) that relate in any way to this Agreement and/or the use of any Submission in a manner consistent with the rights granted under this Agreement, including without limitation any claim for idea misappropriation. Additionally, to the extent permitted under applicable law, you hereby waive any and all rights that you may have under laws worldwide that concern “moral rights” or “droit moral,” or similar rights, in connection with any Submission (and you hereby represent and warrant that you have obtained clear, express written waivers from any applicable third parties with respect to any and all rights that such third parties may have under such laws in connection with any Submission that you post). At any time upon our request, you shall: (i) take or cause to be taken all such actions as we may reasonably deem necessary or desirable in order for us and the Affiliates to obtain the full benefits of this Agreement and any licenses granted by you hereunder, and (ii) execute a non-electronic hard copy of this Agreement.
8. No Obligation to Use.We may determine in our sole discretion whether or not to exercise any right granted to us under this Agreement, and we shall have no obligation to (i) use or otherwise exploit any Submission or (ii) include any Submission on the TUESDAY IN LOVE WEBSITE or in any other services or materials.
9. Unsolicited Input

Notwithstanding anything to the contrary in this Agreement, we and the Affiliates do not accept, invite or consider unsolicited submissions or input of ideas, proposals or suggestions (“Unsolicited Input”), whether related to the TUESDAY IN LOVE WEBSITE, our products or otherwise. You hereby acknowledge and agree that (a) any Unsolicited Input is not confidential and Hudson America Inc. and the Affiliates have no confidentiality obligations with respect to such Unsolicited Input and (b) to the extent permitted under applicable law, any Unsolicited Input will become our and the Affiliates’ sole property. Neither we nor any Affiliate has any obligation with respect to Unsolicited Input, and we and the Affiliates may use Unsolicited Input for any purpose whatsoever without compensation to you or any other person.

1. Monitoring; Reporting of Objectionable Materials

We may, but have no obligation to: (a) monitor, evaluate or alter Submissions before or after they appear on the TUESDAY IN LOVE WEBSITE; (b) seek to verify that any or all rights, consents, releases and permissions in or relating to a Submission have been obtained by you in accordance with your representations above; and/or (c) refuse, reject or remove any Submission at any time or for any reason (including without limitation if we determine in our sole discretion that all rights, consents, releases and permissions have not been obtained by you despite your representations above). You agree to cooperate with us in our verification and inquiries related to the foregoing. We may disclose any Submissions and the circumstances surrounding their transmission to anyone for any reason or purpose, and in accordance with our Privacy Policy. Such information and materials are protected by copyright, trademark, patent and/or other proprietary rights and laws. TUESDAY IN LOVE IS NOT RESPONSIBLE OR LIABLE FOR ANY THREATENING, DEFAMATORY, OBSCENE, OFFENSIVE OR ILLEGAL CONTENT OR CONDUCT OF ANY OTHER PARTY (INCLUDING WITHOUT LIMITATION ANY TUESDAY IN LOVE INDEPENDENT SALES REPRESENTATIVE), OR ANY INFRINGEMENT BY A THIRD PARTY OF ANOTHER’S INTELLECTUAL PROPERTY, PRIVACY OR OTHER RIGHTS. IN NO EVENT SHALL TUESDAY IN LOVE’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT OR OTHERWISE) ARISING FROM OR RELATED TO THIS AGREEMENT, THE TUESDAY IN LOVE WEBSITE, OR YOUR USE OF OR INABILITY TO USE THE TUESDAY IN LOVE WEBSITE EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR USING OR ACCESSING THE TUESDAY IN LOVE WEBSITE. Applicable law may not allow for exclusions or limitations of certain damages; solely to the extent that such law applies to you, some or all of the above exclusions or limitations may not apply to you, and you may have additional rights. For example, in some jurisdictions, a website operator may not exclude or limit liability for personal injury or death directly resulting from the use of such operator’s website or such operator’s negligence.

1. Indemnification

Except to the extent prohibited under applicable law, you will defend, indemnify and hold harmless TUESDAY IN LOVE, the Affiliates, and its and their respective directors, officers, employees, agents, representatives, licensors or providers from and against any and all allegations, claims, actions, demands, causes of action and other proceedings (“Claims”) arising from or related to any of the following: (a) your use of, inability to use, or activities in connection with the TUESDAY IN LOVE WEBSITE; (b) any violation of this Agreement or any other TUESDAY IN LOVE terms, conditions or policies by you; (c) any Transaction; (d) any Submission or other materials that you make available through the TUESDAY IN LOVE WEBSITE (including without limitation any Claim that such Submission or other materials or the use thereof caused damage to, or infringed or otherwise violated the intellectual property, privacy, or other rights of, any third party); or (e) your violation of any rights of any TUESDAY IN LOVE WEBSITE visitor, user, or customer, or any other third party; and you agree to reimburse TUESDAY IN LOVE, the Affiliates and its and their respective directors, officers, employees, agents, representatives, licensors or providers on demand for any damages, losses, costs, judgments, fees, fines and other expenses they incur (including attorneys’ fees and court costs) as a result of any such Claim(s).

1. Termination and Enforcement

This Agreement is effective until terminated. You agree that TUESDAY IN LOVE, at its sole discretion, may suspend, restrict or terminate your access to or use of the TUESDAY IN LOVE WEBSITE, at any time and for any reason, including without limitation if TUESDAY IN LOVE believes that you have violated or acted inconsistently with the letter or spirit of this Agreement (including without limitation your failure to comply with the rules of conduct set forth in Section 4 above), subject to any restrictions placed on TUESDAY IN LOVE’s exercise of such rights under applicable law. Upon any such termination, your right to use the TUESDAY IN LOVE WEBSITE will immediately cease. You agree that any suspension, restriction or termination of your access to or use of the TUESDAY IN LOVE WEBSITE may be effected without prior notice and that TUESDAY IN LOVE may immediately deactivate or delete any user name and/or password used by or provided to you, and all related information and files associated therewith, and/or bar any further access to such information or files. You agree that TUESDAY IN LOVE shall not be liable to you or any third party for any suspension, restriction or termination of your access to the TUESDAY IN LOVE WEBSITE or to any such information or files, and shall not be required to make such information or files available to you after any such termination, suspension or restriction. TUESDAY IN LOVE reserves the right to take steps that TUESDAY IN LOVE believes are necessary or appropriate to enforce and/or verify compliance with this Agreement (including without limitation in connection with any legal process relating to your use of the TUESDAY IN LOVE WEBSITE and/or a third party claim that your use of the TUESDAY IN LOVE WEBSITE is unlawful or violates such third party’s rights). Sections 1, 5-8 and 11-22 of this Agreement shall survive any expiration or termination of this Agreement.

1. Claims of Copyright Infringement

The Digital Millennium Copyright Act of 1998 (the “DMCA”) provides recourse for copyright owners who believe that material appearing on the Internet infringes their rights under U.S. copyright law. If you believe in good faith that materials available on the TUESDAY IN LOVE WEBSITE infringe your copyright, you (or your agent) may send TUESDAY IN LOVE a notice requesting that TUESDAY IN LOVE remove the materials or disable access to them. If you believe in good faith that someone has wrongly filed a notice of copyright infringement against you, the DMCA permits you to send TUESDAY IN LOVE a counter-notice. Notices and counter-notices must meet the then-current statutory requirements imposed by the DMCA. We suggest that you consult your legal advisor before filing a notice or counter-notice. Also, please be aware that there are penalties for false claims under the DMCA.

1. Governing Law; Dispute Resolution

This Agreement shall be governed by the laws of the Province of Ontario without regard to its conflicts of laws principles. You agree that any dispute or claim arising out of or relating to this Agreement or your access to or use of the TUESDAY IN LOVE WEBSITE shall be resolved only in the courts located in the judicial district of Toronto, Province of Ontario and you hereby consent and submit to the jurisdiction of such courts for the purposes of litigating any such dispute or claim.

1. Miscellaneous

If any provision of this Agreement shall be deemed to be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these terms and shall not affect the validity and enforceability of any remaining provisions. This Agreement does not, and shall not be construed to, create any partnership, joint venture, employer-employee, agency or franchisor-franchisee relationship between you and TUESDAY IN LOVE. You may not assign, transfer or sublicense any or all of your rights or obligations under this Agreement without our express prior written consent. No waiver by either party of any breach or default hereunder will be deemed to be a waiver of any preceding or subsequent breach or default. Any heading, caption or section title contained herein is inserted only as a matter of convenience, and in no way defines or explains any section or provision hereof. This Agreement, together with all agreements and statements referred to herein and incorporated herein by reference, is the entire agreement between you and TUESDAY IN LOVE relating to the subject matter hereof and, except as otherwise provided herein, supersedes any and all prior or contemporaneous written or oral agreements or understandings between you and TUESDAY IN LOVE relating to such subject matter. Notices to you may be made by posting a notice (or a link to a notice) to the TUESDAY IN LOVE WEBSITE, by email, or by regular mail, at TUESDAY IN LOVE’s discretion. Without limitation, you agree that a printed version of this Agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this Agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. Except as expressly set forth in the following sentence, nothing in this Agreement, express or implied, is intended to or shall confer on any person (other than the parties and their respective successors or permitted assigns) any rights, remedies, obligations or liabilities.

RISK OF PRODUCT LOSS 
All items purchased from Tuesday in Love are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

IMPORT FEES 
Tuesday in Love has no control over the import regulations of any country. There should be no fees for any country that enjoys free trading with Canada (like the United States), but local authorities will do what they will do. We shall not be responsible for any import duties, customs, or any other regulatory taxes or fees; the responsibility for these shall be entirely yours.

PRODUCT RETURNS AND REFUNDS

Any products returned to the distribution office by the customer will be inspected by Tuesday in Love before consideration of exchange or refund. A restocking fee of 15%-35% may be applied based on how much product has been returned. Tuesday in Love does not guarantee full refund of returned merchandise. Refunds may take anywhere from 4-6 weeks and will only be made online through Paypal. Tuesday in Love is not responsible for damages caused during delivery or inspections by local customs authorities. Tuesday in Love will not offer refunds for items that have been opened during transport or delivery. This offer is subject to change without notice.

PRODUCT DESCRIPTIONS 
Tuesday in Love and its affiliates attempt to be as accurate as possible. However, Hudson America Inc. does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free.

AFFILIATE PROGRAM TERMS AND CONDITIONS 

By participating in the Tuesday in Love Affiliate Program (“Program”), you agree with the terms and policies set forth in the agreement (“Agreement”) below.

Please read the entire Agreement. It is a legal agreement between you and Tuesday in Love. By submitting the online application, you are agreeing that you have read and understand the terms and policies of this Agreement, and that, if Tuesday in Love accepts your application, you agree to be legally responsible for each and every term and policy.

Your participation in the Program is solely for the purpose of legally advertising Tuesday in Love to receive a commission on products purchased by your referrals.

This Agreement begins when Tuesday in Love accepts you into the Program and will end when your participation is terminated.

Tuesday in Love may change the Program or this Agreement at any time without notice. If any change to the Program or the Agreement is unacceptable to you, your only choice is to terminate your participation. Your continuing participation in the Program will constitute your acceptance of any change.

You or Tuesday in Love may suspend or terminate your participation in the Program at any time for any reason. You are only eligible to earn commissions while you are participating in the Program in accordance with the terms of this Agreement.

REFERRALS

Tuesday in Love will attribute referrals to you based on a tracking code embedded in your affiliate links. When a referral clicks through your affiliate link, we set a cookie that contains your tracking code in the browser. We may also record the IP address of the browser or use similar technology to identify the browser.

When the referral decides to buy a product at Tuesday in Love, a script will look for the cookie or use similar technology to identify you and award the commission. Referrals from your affiliate link may make a purchase up to 30 days later and Tuesday in Love will still award the commission, as long as the cookie is still present in the browser.

Tuesday in Love reserves the right to refuse service to any referral.

COMMISSIONS

Tuesday in Love will pay you a commission on products purchased by your referrals according to the Program payment schedule set by Refersion.

Tuesday in Love uses an affiliate tracking system to tabulate and track sales and commission payments due to our affiliates after the tracking process and purchases are completed. Through the affiliate tracking system website, you will have access to the information that we use to determine commissions we owe you.

Tuesday in Love reserves the right to increase or decrease commission rates from time to time as it sees fit.

There is no maximum commission limit.

If a referral returns a product or if the referral requests a chargeback on the purchase, you will not receive a commission. In such cases, Tuesday in Love returns all money to the referral, so you must also return your portion of the sale. Because of the return period for all Tuesday in Love products, and because of periodic processing, Tuesday in Love may hold your commission payout for a period of up to three months.

REVERSALS

Tuesday in Love reserves the right to reverse referrals due to order cancellations, duplicate tracking, returns, disputed charges, and Program violations as outlined in these terms and policies.

Additionally, if we ask you for clarification or more information on any orders or clicks that we suspect may be in violation of Program terms and policies, we expect that you will respond in a timely and honest manner. Below are violations of our communications policy.

1) You are not forthcoming, you are intentionally vague, or you are found to be lying.

2) You are not responsive within a reasonable time period and after multiple attempts to make contact using the information listed in your network profile.

3) You cannot substantiate or validate the source of your traffic to our website with clear and demonstrable proof.

If any of the above apply, then we reserve the absolute right to suspend you from the Program, reverse referrals, modify payouts, set your commission to 0%, or immediately terminate your participation in the Program.

We know that many violations are a result of automated processes. However, it is incumbent upon each affiliate to ensure that it has the appropriate checks and balances in place to address such issues proactively and to adhere to the terms and policies of this Agreement.

ASSETS

The tools, products, and creative assets (collectively "Assets") that Tuesday in Love provides to you include valuable information vital to the success of the Program, including a tracking code that Tuesday in Love uses to attribute referrals to you.

Tuesday in Love grants to you a nonexclusive, nontransferable license ("License") to use Assets as specified under the terms and policies of this Agreement. The term of the License shall expire upon your departure from the Program or termination of this Agreement.

You will use the Assets as Tuesday in Love instructs:

1) You agree that you will not corrupt, modify, or disable the tracking functionality in the Assets.

2) You will not alter, add to, subtract from, or otherwise modify the Assets as Tuesday in Love provides them unless you obtain prior written consent from Tuesday in Love.

3) You may only use the Assets for the purpose of promoting Tuesday in Love and its products.

4) Tuesday in Love retains all rights, ownership, and interest in the Assets, and in any copyright, trademark, or other intellectual property in the Assets. Nothing in this Agreement shall be construed to grant you any rights, ownership, or interest in the Assets, or in the underlying intellectual property, other than the License to use Assets as granted in this Agreement.

5) You will not make any claim to ownership of the Assets, or of the copyright, trademark, or other intellectual property therein.

EMAIL

Under no circumstances shall you send spam related to the Tuesday in Love affiliate program. Spam is defined as commercial messages in the Federal spam law, CAN-SPAM Act of 2003 (“Act”).

Tuesday in Love reserves the right to collect, withhold, or cancel any and all compensation related to commercial messages that you send.

You may send transactional or relationship messages as defined in the Act.

SOCIAL MEDIA

Tuesday in Love permits you to promote offers on Facebook, Twitter, blogs, discussion forums, and other social media following these general guidelines:

1) You ARE ALLOWED to post your affiliate links on your own social media and websites.

2) You ARE PROHIBITED from posting your affiliate links on the social media and websites of Tuesday in Love.

KEYWORDS

You shall not purchase keywords, domain names, advertising, search terms, adwords, or any other identifiers that include the word “Tuesday in Love,” the names of Tuesday in Love products or services, or any variations or misspellings thereof.

Specifically, this policy prohibits you from:

1) Bidding on “Tuesday in Love” and any keyword string that includes this term, such as “Tuesday in Love nail polish” or “Tuesday in Love makeup” or “Tuesday in Love halal cosmetics” or “Tuesday in Love promotions”; and

2) Bidding on “halal nail polish” and any keyword string that includes this term, such as “halal cosmetics” 

3) Purchasing domain names based on “Tuesday in Love” or variations, such as “Tuesday in LoveCosmetics.com” or “Tuesdayinlove.co” or “www.TuesdayinLove-review.org”.

RELATIONSHIP

This Agreement shall not be construed to create any employment relationship, agency relationship, or partnership between you and Tuesday in Love. You will provide services for Tuesday in Love as an independent contractor. You will have no authority to bind Tuesday in Love into any agreement, nor will you be considered an agent of Tuesday in Love in any respect.

Tuesday in Love will not be responsible for any taxes that you owe arising out of your relationship with Tuesday in Love as set forth in this Agreement. Tuesday in Love will not withhold any taxes from the commissions paid to you.

You shall include a disclosure statement within any and all pages or posts where you use affiliate links in an endorsement or review, and where it is not clear that the link is a paid advertisement. This disclosure statement should be clear and concise, stating that Tuesday in Love is compensating you for your review or endorsement.

PROHIBITED CLAIMS

You shall not make claims that Tuesday in Love products or services are intended to diagnose, treat, cure, or prevent any disease.

WARRANTIES

Tuesday in Love makes no express or implied warranties or representations with respect to the Program.

Tuesday in Love makes no representation that the operation of the Program will be uninterrupted or error-free, and Tuesday in Love will not be liable for the consequences of any interruptions or errors.

You represent and warrant the following:

1) You have the legal authority to enter into this Agreement and to be bound to the terms and policies set forth in this Agreement.

2) Your website does not contain any materials that are:

(a) Unlawful or solicitous of behavior that is unlawful in Canada or the United States;

(b) Unlawful or solicitous of behavior that is unlawful in the geographic area from which you operate.

3) You have obtained any necessary clearances, licenses, or other permission for any intellectual property used on your website. Nothing on your website infringes upon the intellectual property rights of any person or entity. No person or entity has brought or threatened an action claiming such infringement, nor do you have any reason to believe that any person or entity will bring or threaten such a claim in the future.

4) You do not compete with Tuesday in Love. You are not an employee, agent, or partner with any person or company that competes with Tuesday in Love. You may be an affiliate with or an independent contractor to persons or companies that compete with Tuesday in Love.

INDEMNIFICATION

You will indemnify and hold harmless Tuesday in Love from any claim, damage, lawsuit, action, complaint, or other costs arising out of any breach of your warranties set forth above. You will also indemnify and hold harmless Tuesday in Love for any damage, loss, or other cost arising out of your use or misuse of the Assets.

CONFIDENTIALITY

Any information that you are exposed to by virtue of your relationship with Tuesday in Love under these terms and policies, which information is not available to the general public, shall be considered to be confidential company information. You may not disclose any confidential company information to any person or entity, except where compelled by law, unless you obtain prior written consent for such disclosure from Tuesday in Love.

LIABILITY

Tuesday in Love will not be liable for any loss of profits or costs, or for any direct, indirect, special, incidental, or consequential damages, including costs associated with the procurement of substitute goods or services (whether Tuesday in Love was or should have been aware or advised of the possibility of such damage), arising out of or associated with any loss, suspension, or interruption of service, termination of this Agreement, use or misuse of the Assets, or other performance of services under this Agreement.
